Privacy Policy

The short version. Your photos, your catalogue, your edits and your ratings live on your Mac. We never see them.

One exception, and it is the whole reason this page exists: when you ask for a critique, that single photo (plus a few frames from the same scene, for context) is uploaded so an AI model can look at it. We do not keep the image. We keep the written critique so returning to that photo costs you nothing.

No analytics. No tracking. No ads. No selling data. Your photos are never used to train any model.

Who is responsible for your data

What stays on your Mac

Almost everything. Fovea is a desktop application, not a cloud service. The following never leaves your computer, and we have no way to see it:

  • Your photographs and RAW files. Fovea never modifies or uploads your originals.
  • Your catalogue, ratings, flags, colour tags, keywords and places.
  • Your develop settings. Edits are stored as a recipe in a sidecar file next to the original and rendered on the fly.
  • Your licence key and your trial identifier, both held in the macOS Keychain.

There is no account to create, no sync, and no backup to our servers. If you never use a critique, Fovea does not send us anything at all beyond the licence check described below.

What we receive, and why

1. Your licence

When you activate Fovea we store your licence key, the app version it unlocks, the email address attached to your purchase, and the times we created and last checked the licence. The key itself is your identity here. There is no password and no separate login. We re-check the key with our payment provider periodically so that refunds and cancellations take effect.

Legal basis: performance of our contract with you (Article 6(1)(b) GDPR). Without this we cannot unlock the software you bought.

2. Your free trial

Starting a trial creates a random identifier on your Mac (a UUID generated by the app and stored in your Keychain) and sends it to us with the trial's expiry date. It is not your device serial number, your Apple ID, your hardware address or anything Apple assigned. It cannot be linked back to you by us or anyone else. It exists so the trial cannot be restarted endlessly, and it is the only thing we hold about a trial user. No name, no email.

Legal basis: performance of a contract, and our legitimate interest in preventing abuse of the free trial (Article 6(1)(b) and (f)).

3. Your credits

We keep an append-only ledger of every credit movement: credits included with your licence, credits you buy, and credits you spend. Each row records the amount, the reason, a reference such as an order number, and a timestamp. This is what your balance is calculated from, and it is also the record that lets you audit any charge.

Legal basis: performance of our contract, and compliance with accounting and tax obligations (Article 6(1)(b) and (c)).

4. Your critiques

This is the only time a photograph is transmitted. When you request a critique, Fovea sends a downscaled JPEG copy of the selected photo, and up to a few downscaled frames from the same scene for comparison, to our server. Our server forwards them to Anthropic's Claude API, which returns the written assessment.

  • We do not store your images. The image data is held in memory only for as long as the request takes, then discarded. It is never written to our database or to disk.
  • We do store the resulting text. The critique, the coaching notes and the region markers are saved against your account so revisiting that photo, or retrying after a dropped connection, does not cost you another credit.
  • Your original file is untouched. Only a reduced-size copy is sent.

Legal basis: performance of our contract with you. You choose, photo by photo, whether this happens. If you never press the critique key, no image is ever sent.

5. Server logs

Our server records operational lines such as the size in kilobytes of an upload and the fact that a purchase was credited. Our hosting provider records standard connection metadata, which includes IP addresses, for security and reliability. We do not use these logs to build a profile of you and we do not combine them with your photos.

Legal basis: our legitimate interest in operating a secure and functioning service (Article 6(1)(f)).

People in your photographs

If a photo you submit for a critique contains identifiable people, that image is personal data about them as well as about you. In that moment you are the one deciding to have it assessed, so please only submit photographs you have the right to use, and think carefully before submitting images that reveal sensitive matters such as someone's health, beliefs, political views, ethnicity or sexuality. Fovea is a tool for judging composition and light. It does not perform facial recognition and does not attempt to identify anyone.

Where your data is processed

We are based in the European Union, but you should know exactly where the processing happens, because it is not all in the EU. Our application server currently runs in the United States (Ashburn, Virginia), and the AI model and payment provider are US companies. If you are in the EU, EEA, UK or Switzerland, using a critique or buying a licence involves transferring your data to the United States.

For those transfers we rely on the safeguards our providers make available, including the European Commission's Standard Contractual Clauses and, where the provider is certified, the EU to US Data Privacy Framework. You can ask us for details of the safeguards that apply.

We do not sell your data, share it with advertisers, or pass it to anyone not listed above.

How long we keep it

  • Photographs: not retained. Discarded as soon as the critique is generated.
  • Critique text: kept while your account exists, so that returning to a photo stays free. Ask us and we will delete it.
  • Licence and credit ledger: kept while your licence is active, and afterwards for as long as tax and accounting rules require records of the sale.
  • Trial records: kept after expiry only to stop the same device restarting the trial repeatedly.
  • Server logs: short-lived, retained by our host on a rolling basis.

Your rights

If you are in the EU, EEA or UK, you have the right to ask us for a copy of your data, to correct it, to have it deleted, to restrict or object to how we use it, and to receive it in a portable form. Where we rely on legitimate interests, you can object and we will stop unless we have compelling grounds not to.

To exercise any of these, email dima@unclank.ai from the address attached to your purchase, or quote your licence key. We will respond within one month. There is no charge.

You can also deactivate your licence at any time from Account and Credits inside the app, which removes the key from your Mac.

If you think we have handled your data badly, please tell us first so we can fix it. You also have the right to complain to your national data protection authority.

Cookies

This website sets no cookies and runs no analytics, no tag manager and no advertising pixels. There is no consent banner because there is nothing to consent to. The only third-party request the site makes is to Google Fonts for the typefaces.

Children

Fovea is not directed at children and we do not knowingly collect data from anyone under 16.

Changes

If we change how any of this works we will update this page and move the date at the top. For changes that materially affect you, we will also tell you in the app or by email.
